Welcome to SchoolCues. These Terms of Service ("Terms") govern your access to and use of the SchoolCues website, applications, and services (collectively, the "Services").
By accessing or using the Services, you agree to be bound by these Terms.
2. Account Registration and Responsibilities
You agree to:
- Provide accurate and complete information
- Maintain the confidentiality of your login credentials
- Be responsible for all activities under your account
You may not:
- Allow minors to access or use your account
- Share login credentials in a manner that compromises security
At registration, you will be required to confirm that you are at least 18 years of age. This confirmation is recorded for compliance purposes.
SchoolCues reserves the right to suspend or terminate accounts that violate these Terms.
3. Customer Role; Data Control
If you are a school or educational organization ("Customer"):
You are the Data Controller
You determine:
- What data is collected
- The purpose of processing
- How data is used
SchoolCues is the Data Processor
We:
- Process data only on your instructions
- Do not independently determine how student data is used
4. Student Data and Legal Compliance
You agree that:
- All student data is submitted only by authorized adults
- You have obtained all required consents and permissions
- Your use of the Services complies with all applicable laws, including but not limited to:
- The Children's Online Privacy Protection Act (COPPA)
- The Family Educational Rights and Privacy Act (FERPA)
SchoolCues does not knowingly collect personal information directly from children.
5. Permitted Use
You may use the Services only for:
- Educational administration
- School-parent communication
- Payment processing and record management
You may not:
- Use the Services for unlawful purposes
- Upload data without proper authorization
- Attempt to access systems or data without permission
6. Intellectual Property and Data Ownership
Your Data. You retain all ownership rights to the data and content you submit to the Services. By using the Services, you grant SchoolCues a limited, non-exclusive license to host, process, and transmit your data solely as necessary to provide the Services.
SchoolCues IP. The Services, including all software, designs, and documentation, are owned by SchoolCues and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Services without our prior written consent.
7. Payments and Third-Party Services
SchoolCues may integrate with third-party providers, including payment processors such as Stripe.
You agree that:
- Payment processing is subject to the third party's terms
- SchoolCues is not responsible for third-party services
8. Data Security
SchoolCues implements reasonable administrative, technical, and organizational safeguards.
However, you acknowledge:
- No system is completely secure
- You are responsible for maintaining appropriate safeguards on your end
9. Data Retention and Deletion
- Data is retained only as necessary to provide the Services
- Schools control student data lifecycle
- Upon termination, schools may export their data within 30 days of the termination date. SchoolCues will delete school and student data within 60 days of termination, except where retention is required by applicable law.
10. Suspension and Termination
We may suspend or terminate your account if:
- You violate these Terms
- A minor is found to be using the platform
- Data is submitted in violation of applicable law
We may remove or delete data associated with such violations.
11. Indemnification
You agree to defend, indemnify, and hold harmless SchoolCues, its officers, directors, employees, and affiliates from any claims, damages, or liabilities arising from:
- Your use of the Services
- Your collection or submission of student data
- Failure to obtain required consent
- Violation of applicable laws
12. Limitation of Liability
To the fullest extent permitted by law:
SchoolCues shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of data, revenue, or business
Total liability shall not exceed the amount paid by you to SchoolCues in the 12 months preceding the claim.
13. Disclaimer of Warranties
The Services are provided "as is" and "as available."
We disclaim all warranties, including:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
14. Changes to the Services
We may modify or discontinue the Services at any time. Where reasonably practicable, SchoolCues will provide at least 30 days' prior notice of material changes to or discontinuation of the Services.
We are not liable for any modification, suspension, or discontinuation.
15. Changes to Terms
We may update these Terms from time to time. For material changes, SchoolCues will provide at least 30 days' advance notice by email or in-app notification. Continued use of the Services after the notice period constitutes acceptance of the updated Terms.

16. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-laws principles.
17. General Provisions
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
No Waiver. Failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
Entire Agreement. These Terms, together with any applicable order forms or agreements, constitute the entire agreement between you and SchoolCues regarding the Services and supersede all prior agreements.
